Der Beschluss des Augustdorfer Gemeinderates, die Kastration von Katzen zur Pflicht zu machen, ist zunächst nicht gültig. Dies hat Bürgermeister Andreas J. Wulf in einer Pressenotiz mitgeteilt.In seiner nächsten Sitzung muss der Rat nun erneut zu dem Thema tagen. Bleibt er bei der Beschlussfassung, müsse die Sache der Kommunalaufsicht zur Entscheidung vorgelegt werden.
Wulf hält die Kastrations- und Kennzeichnungspflicht in Form einer Verordnung nämlich für rechtlich nicht zulässig. Greife der Gemeinderat mit seinem Beschluss doch in das geschützte Eigentums- und Freiheitsrecht der Katzenhalter ein. Dies sei nur dann erlaubt, wenn eine Gefahr für die öffentliche Sicherheit und Ordnung bestehe, die durch eine Kastrations- und Kennzeichnungspflicht der Vierbeiner gemindert oder beseitigt werden könne.
Keine Gefahr durch nicht-kastrierte Katzen
Das Augustdorfer Gemeindeoberhaupt verweist auf die Ansicht von juristischen Experten des Städte- und Gemeindebundes Nordrhein-Westfalen, die eine Gefahr für die öffentliche Sicherheit und Ordnung durch nicht-kastrierte Katzen in der Regel verneinen. Dieser Argumentation schließt sich laut Wulf die Deutsche Juristische Gesellschaft für Tierrecht an. Lediglich wenn es im Gemeindegebiet einen erheblichen Bestand an leidenden Katzen gäbe, könnten die Voraussetzungen erfüllt sein. Dies sei in Augustdorf aber nicht der Fall, meint Wulf. Daher müsse er den Ratsbeschluss vom 11. Juli beanstanden – die betreffende Verordnung der Gemeinde wird nun bis auf weiteres nicht geändert.
